Zimbabwe: New Constitution Would Criminalize Homosexuality, Ban Marriage Equality

The final draft constitution, earmarked to replace the Lancaster House Constitution, will criminalise homosexuality and ban same-sex marriages according to the views of the majority of Zimbabweans, it has emerged.

In an interview, Constitution Select Committee (Copac) co-chair Mr Edward Mkhosi (MDC) said Zimbabwe had unequivocally affirmed that homosexuality should be outlawed.

“During the outreach programme, everyone said ‘no’ to gays and lesbians and, as the drafters, we heed what people say,” he said. “Contrary to media reports that the homosexuality issue was causing infighting, the people were clear; we did not waste time on it.”

Nepal: Hundreds March for Gay Rights

Nepal Gay RightsHundreds of gay, lesbian, transgender people marched with supporters in a southern Nepal town Sunday to demand equal rights under a new constitution the country is in the process of writing.

The estimated 500 demonstrators danced, chanted slogans and marched around Narayanghat, a town about 100 miles (160 kilometers) south of the capital of Katmandu on Sunday, which is also Nepal’s traditional festival of Gaijatra honoring the dead.

The gay community has been holding demonstrations on the festival day in the capital, but it was the first time that activists have organized a rally outside the capital.

Nepal: New Constitution Would Include Marriage Equality

Nepal New ConstitutionFollowing centuries of monarchy and a decade-long civil war that ended in 2006, Nepal has emerged as a democratic republic with one of the world’s most progressive stances on LGBT rights, which could be promulgated in a new constitution this year unless the government further delays its implementation.

“The LGBT issues are pretty well formulated in the draft, and there is no opposition, so we don’t need to worry about that,” says Sunil Pant, Nepal’s first openly gay elected official and a member of the interim constituent assembly writing the document. “Our concern is about how long it will take to have the constitution.”

Pant, who is pushing for adoption of the constitution this year, says the draft proposes citizenship rights for “third gender” individuals, who identify as neither male nor female; bans discrimination based on sexual orientation and gender identity; calls for government affirmative action in support of LGBT people; and proposes gender-neutral language on the rights to work, health, education, and marriage, the latter also being drafted in a separate law directed by a supreme court ruling.

Kenya: Does New Constitution Protect Gays/Lesbians?

A lot of people have kicked up much dust on the controversial matter of gay rights. But much of that dust has produced a lot of heat, and no light. That’s why I must tell you what my crystal ball says.

Let me state the bottom line up-front – the Constitution protects gay rights. Period – plain and simple. This is both a statement of fact and law. But the Constitution goes even further. It does not prohibit same-sex marriages.

As any average first year law student knows, a liberty or freedom that is not prohibited is permitted. But more is at stake. Are we going to be ruled by fear and hatred, or love? I have said it before, and will do so yet again. Kenya is not a theocracy.

Zimbabwe: President Confirms No Gay Rights in New Constitution

Zimbabwe’s president says gay rights will not be protected in a constitution being drawn up under a power-sharing deal. State radio on Friday quoted President Robert Mugabe saying that Western rights groups have called for constitutional reforms to include gay rights. He calls that “insanity.”

Same-sex acts are illegal in Zimbabwe. Mugabe once described homosexuals as “lower than pigs and dogs.”

Condemnation of gays is common in Africa. Ugandan lawmakers have proposed imposing the death penalty on some gays. A gay couple is on trial in Malawi, charged with unnatural acts and gross indecency.
