NM: Senators Urged to Support Repeal of DOMA

A new effort from New Mexico advocates and the Courage Campaign urges U.S. senators Jeff Bingaman and Mark Udall to support legislation that would repeal the Defense of Marriage Act.

Marriage equality advocates joined by LGBT activist Cleve Jones hand delivered more than 1,000 messages to the senators’ offices in Albuquerque on Monday. The messages, which ask the senators to support the DOMA repeal legislation sponsored by Senator Diane Feinstein of California, were gathered by the Courage Campaign, partner organization Progress New Mexico, and Democracy for New Mexico, a political blog.

According to a news release, “On April 27, Mary Ellen Broderick and Barb Wold, a lesbian couple living in Albuquerque for the past 18 years and publishers of the Democracy for New Mexico blog, wrote to the three organizations’ members and readers in the state, alerting them that Sens. Bingaman and Udall are not co-sponsors of Sen. Feinstein’s legislation.

NM: Anti Marriage Equality Bills Defeated

Members of the gay community are celebrating after three heated bills centering on the definition of marriage were defeated. The set of marriage bills were so important that dozens of people were willing to wait hours on Thursday to hear their fate.

The bills under consideration would allow a vote on whether to change the state constitution to define marriage between one man and one woman. A legislative committee heard emotional testimony from both sides of the issue.

“Let us, the citizens of New Mexico, take charge and decide what a family is,” said a supporter of the bill. “That is the real impact of these bills on human beings,” said a detractor of the bill.

NM: GOP Lawmaker Introduces Gay Marriage Ban

Nora EspinozaYesterday Tea Party-backed GOP state Rep. Nora Espinoza introduced a state-level version of DOMA. Equality New Mexico reports on their Facebook page:

This very concept of creating less equal classes of people has been fought against for generations in New Mexico and is contrary to our state’s proud traditions of providing equal protection and opportunity for her citizens from every background and community.

Similar legislation was defeated last year when it was tabled in the Senate Rule Committee. This year, however, promises greater challenges given the much more conservative make up of both our state legislature and governor’s office.

NM: GOP Wants to Outlaw Marriage Equality in 2011

Outlawing gay marriage already was headed to the Legislature’s inbox, but an attorney general’s opinion supporting the validity of some same-sex unions could give the issue a higher profile.

Attorney General Gary King said this week that New Mexico courts likely would recognize the legality of same-sex marriages performed in other states or countries where they’re legal. The opinion, while non-binding, was praised by same-sex marriage supporters as logical and helpful to couples wondering about their status. Recognizing such marriages “strengthens families; it gives you the tools and the security to build a life together and protect your family,” said Lynn Perls, an Albuquerque lawyer who specializes in family law.

But Sen. William Sharer, R-Farmington, said Wednesday that King’s opinion has galvanized opponents of same-sex marriage and could help his efforts to get a measure through the 2011 session making such marriages illegal.

NM: Attorney General Says State Could Recognize Out of State Gay Marriages

Gay marriage advocates received some good news on Tuesday as New Mexico Attorney General Gary King issued an opinion stating that gay marriages from out of state would likely be legal here. King came to this conclusion after “a comprehensive legal analysis” by his office which said that New Mexico can recognize same-sex marriages from states where it’s legal.

“While we cannot predict how a New Mexico court would rule on this issue, after review of the law in this area, it is our opinion that a same-sex marriage that is valid under the laws of the country or state where it was consummated would likewise be found valid in New Mexico,” King said.

While 40 states explicitly bar gay marriage, King says that New Mexico’s law does “not explicitly address the recognition of same-sex marriages from other jurisdictions,” according to the release announcing the opinion.
