CA: Former Closeted State Senator Takes Issue With Civil Marriage Religious Freedom Bill

A new clash over a State Bill dealing with same sex marriage is emerging and two of the main opponents are San Francisco Democratic Senator Mark Leno and Bakersfield’s Republican Senator Roy Ashburn, two openly gay California legislators. Senate Bill 906, commonly called the Civil Marriage Religious Freedom Act was introduced back in January by Senator Leno with the support of Equality California, the state’s largest gay rights advocate. The California Assembly passed the bill early August 46-25 followed by a 22-11 vote in favor of the bill by the State Senate.

The bill details, perhaps to some, a premature safe guard to religious institutions allowing them freedom to choose who they will and will not sanctify in marriage. The bill would protect clergy who decline to perform marriage ceremonies that conflict with their religious beliefs. In the language of bill, religious institutions would also be protected from losing their tax exempt status for any refusals.

In a state whose position on the legalization of same sex marriage hangs in the balance at the 9th Circuit court of Appeals, some may find SB 906 as a prediction of the outcome of the upcoming trial. If marriage of same sex couples becomes legal, California’s legislature has given religious institutions the power to practice their faith without the state imposing new restrictions when it comes to performing same sex weddings.

CA: Outed Republican Roy Ashburn Calls on GOP to Support Gay Rights

State Sen. Roy Ashburn, the Bakersfield Republican who came out as gay earlier this year after a drunk driving arrest in Sacramento, has penned a bold column on why his fellow GOPers should wholeheartedly support civil rights for gays and lesbians.

In the piece published on the website gaypolitics.com, run by the Gay and Lesbian Victory Fund that supports gay and lesbian candidates for office, Ashburn writes, “Gay people being treated with respect and having the same opportunities for a good life regardless of sexual orientation should not be topics of political debate. How can it possibly be that there is a partisan political divide over equal rights in America?”

Ashburn had one of the Legislature’s strongest records of voting against bills to expand rights for LGBT Californians, but he says he deeply regrets those votes and wrote, “I look back now knowing there is so much more I could have done to inform the public about LGBT people and to fight for equal rights under the law. Regrettably and selfishly, I took another path in my life and political career – I chose to conceal who I truly am and to then actually vote against the best interests of people like me. All this was done because I was afraid – terrified, really – that somehow I would be revealed as gay.”

CA: Outed State Senator Talks Gay Rights on Senate Floor

Two months after announcing he was gay, state Sen. Roy Ashburn of Bakersfield discussed his sexuality on the Senate floor and cast votes on two separate gay-rights bills. Ashburn was the only Republican senator to vote in support of allowing openly gay people to serve in the military, but he also voted against a bill that could remove a political obstacle to proposals to legalize same-sex marriage.

Ashburn then took the unusual step of publicly explaining his votes on the Senate floor. “I would not have been speaking on a measure dealing with sexual orientation ever prior to the events that have transpired in my life over the last three months,” Ashburn told his colleagues. “However, I am no longer willing or able to remain silent on issues that affect sexual orientation and the rights of individuals. And so I am doing something that is quite different and foreign to me, and it’s highly emotional.”

Ashburn, who has regularly voted against gay rights bills in the past, announced he is a homosexual in March after he was arrested for drunk driving after he allegedly left a gay nightclub.

CA: State Senator Ashburn Offically Comes Out

In the end, Sen. Roy Ashburn said he decided he owed his constituents an explanation. He went on a radio show first thing Monday morning to talk about his sexual orientation. Then the Bakersfield Republican returned to the state Senate floor, where colleagues greeted him with handshakes and hugs.

“I’m gay. Those are the words that have been so difficult for me for so long,” Ashburn, 55, told KERN conservative radio host Inga Barks.

Ashburn, who has voted consistently against gay-rights measures, last week refused to address reports that he was at a gay bar in Sacramento before his 2 a.m. arrest Wednesday for driving under the influence.

CA: Anti Gay Republican State Senator Ashburn Caught Leaving Gay Bar

The sexual orientation and voting record of state Sen. Roy Ashburn exploded into national news Thursday, the day after he was arrested on misdemeanor drunk driving charges in Sacramento. Ashburn, R-Bakersfield, did not return calls again Thursday seeking an explanation of the events leading up to his arrest and the Sacramento television report that launched nationwide speculation that the veteran lawmaker is gay and therefore a hypocrite for voting against gay-rights bills.

Ashburn has taken a personal leave from the Senate for an unknown length of time, his spokesman said. The Californian has asked Ashburn about his sexual orientation in the past. He has either questioned the relevance of the issue or dodged it altogether. The newspaper did not report the comments at the time, also deciding it was not relevant.

That all changed Thursday after Sacramento television station CBS13 quoted unnamed sources as saying Ashburn was arrested after leaving Faces, a gay nightclub in midtown Sacramento. Like a fast-moving wildfire, other television stations and bloggers nationwide including the Huffington Post and FoxNews.com reported the same, many citing CBS13′s story.
