CA: San Francisco Bi-National Couple May Benefit From Obama Administration Decision

A San Francisco gay couple facing the threat of deportation may obtain relief through a surprise decision by the Obama administration to consider same-sex marriage when deciding whom to deport.

Bradford Wells, 55, a U.S. citizen, and Anthony John Makk, 48, a citizen of Australia, have resided in the Castro district for much of their 19-year relationship. They were married in Massachusetts seven years ago, but a series of visas Makk had used to remain legally in the United States expires by Aug. 25.

The administration’s new policy, announced Thursday, calls for reviewing on a case-by-case basis each of more than 300,000 pending deportations to determine which cases to pursue and which to ignore on the basis of family relationships, criminal history and other factors.

Obama Administration Cites Doma, Breaks Up Married Binational Gay Couple

Citing the Defense of Marriage Act, the Obama administration denied immigration benefits to a married gay couple from San Francisco and ordered the expulsion of a man who is the primary caregiver to his AIDS-afflicted spouse.

Bradford Wells, a U.S. citizen, and Anthony John Makk, a citizen of Australia, were married seven years ago in Massachusetts. They have lived together 19 years, mostly in an apartment in the Castro district. The U.S. Citizenship and Immigration Services denied Makk’s application to be considered for permanent residency as a spouse of an American citizen, citing the 1996 law that denies all federal benefits to same-sex couples.

The decision was issued July 26. Immigration Equality, a gay-rights group that is working with the couple, received the notice Friday and made it public Monday. Makk was ordered to depart the United States by Aug. 25. Makk is the sole caregiver for Wells, who has severe health problems.

Defense of Marriage ActKing & Spalding is the law firm that is being paid to defend DOMA even though the President and our Attorney General have decided to agree with the Courts that – The Defense of Marriage Act is unconstitutional and hence the related appeals and cases should not be defended.

King & Spalding is an international law firm with more than 800 lawyers in Abu Dhabi, Atlanta, Austin, Charlotte, Dubai, Frankfurt, Geneva, Houston, London, New York, Paris, Riyadh (affiliated office), San Francisco, Silicon Valley, Singapore and Washington, D.C. Speaker Boehner is retaining a $250 -$450 per hour attorney, Paul Clement – from King Spalding to defend the DOMA cases.

Mitch Landy, HarpistMitch Landy combines a classical music education with his own eclectic musical tastes, bringing a fresh approach to the harp. He lived in Philadelphia until 1991, and was very involved in the city’s Irish music community. His involvement with Irish music exposed him to the magic of the Celtic harp, and he went on to adapt pieces from the classical literature to the harp, an instrument traditionally associated with Irish music.

Soon after, he learned to play the concert harp , with its greater facility to handle the key changes and complex harmonies of classical and pop music.

Mitch won 2nd prize on the Celtic harp at the 1995 International Pop & Jazz Harpfest, and now focuses his talents on the rich harmonic potential of the pedal harp, arranging jazz classics from the 20′s and 30′s, as well as contemporary music, and improvisation; and of course, classical pieces. Never limiting himself to an existing repertoire of published harp music, he continues to perform mostly his own arrangements, and brings a unique to everything he plays.
