Will Spain’s Conservatives Overturn Marriage Equality Law There?

Wednesday, February 8th, 2012

Spain Marriage EqualitySpaniards have been taken by surprise by the new conservative government’s aggressive efforts to implement social reforms, overturning several liberal laws passed by the previous government amid tremendous economic uncertainty.

The previous Socialist government passed a substantial amount of liberal legislation in the last eight years, including limiting the role of the Catholic Church in the state, legalizing gay marriage, relaxing abortion restrictions, and reforming the educational curriculum.

While the Catholic Church and the ruling Popular Party accused Socialists of imposing an ideologically-motivated agenda too quickly, Socialists said they were only harmonizing Spanish laws with European standards – with the support of the majority of Spanish citizens. Dozens of polls over the past three years have consistently showed an even split on social issues.

Jose Luis Rodriguez Zapatero, Spain’s former prime minister, says passing a gay marriage law is his proudest achievement.

Mariano Rajoy and his conservative Popular Party (PP) won control of Parliament in a landslide victory last month as Spain shifted hard to the right while struggling under piles of debt and sky-high unemployment.

The power shift could be the undoing of the nation’s gay marriage law, which was approved during the tenure of the Socialist Zapatero. Rajoy has suggested he would “change” the law and his party has filed a legal challenge based on technical grounds.

Tuesday, November 22nd, 2011

Spain Marriage EqualityThe election of a conservative, Mariano Rajoy, as Spain’s prime minister has some LGBT activists worried he will try to repeal the nation’s marriage equality law.

Rajoy’s Popular Party has filed a suit challenging the law, and he has said he believes it is unconstitutional and that he prefers civil unions to marriage for same-sex couples. However, during the campaign he softened his rhetoric, and his platform did not include repeal of the law, the Bloomberg news service reports.

He told Spanish newspaper El Pais that the Constitutional Court would have the final word on the law, enacted in 2005 under Socialist prime minister Jose Luis Rodriguez Zapatero.

Spain: Gay Community Fearful Conservatives Will Repeal Marriage Equality After Election

Wednesday, November 16th, 2011

Isabel Descals and her girlfriend raced to get hitched before Sunday’s general elections in Spain almost sure to be won by the anti-gay marriage conservative opposition.

The Popular Party (PP) has appealed to the Constitutional Court against Spain’s gay marriage law, which has allowed over 20,000 gay couples to wed since it was passed by the Socialist government in 2005.

Opposition leader Mariano Rajoy has repeatedly said he prefers the term “civil union” to “marriage” for same-sex unions. “We listened to what the PP says and they are going to take a step backwards, at least when it comes to marriage because Rajoy has said he prefers civil unions,” said Descals, a 40-year-old manager from Valencia.

Six and a half years after Spain passed a law allowing marriage between same sex couples, could Spain be about to turn its back on LGBT equality?

Many Spaniards fear the possibility that the country will become the first to withdraw that right if, as expected, Spain elects a conservative Partido Popular (PP) led government in November’s elections.
