DC: Why Are Republicans Waiting to Try to Repeal Marriage Equality Law?

In the five months since they took control of the House, Republicans have banned government-funded abortions in the District, revived a private-school voucher plan and tried — so far unsuccessfully — to end the city’s needle-exchange programs.

Yet despite past efforts, Republicans have not mounted an assault this year on the District’s same-sex marriage law: No bill has been introduced to overturn it, nor has any lawmaker publicly sought support from colleagues for such a measure.

Del. Eleanor Holmes Norton (D-D.C.) and other city activists are preemptively lobbying against any efforts to repeal the law. On Tuesday, she criticized Republicans for their efforts to slow the repeal of the “don’t ask, don’t tell” policy on gays in the military. The issue was important, she said in a news release, “considering our determination to preserve our own marriage equality law, which is under attack in the House.”

DC: Gay Marriage Foes Turn to Congress for Repeal

Brian BrownOpponents of gay marriage in the District of Columbia say they’ll press on despite a recent Supreme Court loss. On Tuesday, the Supreme Court rejected an appeal from gay marriage foes hoping to put the city’s gay marriage law up for a vote.

The court announced without comment that it would not hear Bishop Harry Jackson’s challenge to a D.C. Board of Elections and Ethics ruling that said putting the question of marriage up for a vote would violate the city’s Human Rights Act (HRA) that prohibits discrimination based on sexual orientation. In rejecting the referendum, the board said it would, if approved, authorize “discrimination in contravention of the HRA.”

Opponents had argued that the board overstepped its authority and that the citizens should have final say on such matters.

DC: Attorney General Asks Supreme Court to Deny Vote Request

Washington DC Gay MarriageBishop Harry Jackson is still demanding that marriage equality be put before the voters of Washington DC despite the fact that it is not required that such a ballot initiative happen.

It has been pointed out that, had the issue of inter-racial marriage been put to the voters of the Southern states in 1970, Whites and Blacks would still not be allowed to marry there. Most of the time, when civil rights for a minority group are put to the ballot, those who gain the most from ensuring the second-class status of a minority group vote against it.

DC Attorney General Peter Nickles and other attorneys in the city have urged the US Supreme Court to not take the case seeking to force a vote on the issue. Nickles notes that the DC Court of Appeals has ruled earlier this year that the District has the authority to prohibit a voter initiative or referendum with regards to the Religious Freedom and Marriage Equality Amendment Act of 2009, or any other referendi or initiatives.
