Zimbabwe: New Constitution Would Criminalize Homosexuality, Ban Marriage Equality

The final draft constitution, earmarked to replace the Lancaster House Constitution, will criminalise homosexuality and ban same-sex marriages according to the views of the majority of Zimbabweans, it has emerged.

In an interview, Constitution Select Committee (Copac) co-chair Mr Edward Mkhosi (MDC) said Zimbabwe had unequivocally affirmed that homosexuality should be outlawed.

“During the outreach programme, everyone said ‘no’ to gays and lesbians and, as the drafters, we heed what people say,” he said. “Contrary to media reports that the homosexuality issue was causing infighting, the people were clear; we did not waste time on it.”

Zimbabwe: Mugabe Reiterates Ban on Marriage Equality, Attacks Gays

PRESIDENT Mugabe yesterday warned Zimbabweans against some fly-by-night pastors and churches that are turning Christianity into money-spinning ventures for their personal enrichment.

President Mugabe also attacked homosexuality, adding that there was no going back on the issue. He said Zimbabwe would continue to recognise marriages involving people of opposite sex only. “The story of love began a long time ago. Marriages are good and the idea should not be spoiled by evil affairs involving men and men.

“No to homosexuality and that remains our slogan. We totally agree with the Seventh-Day Adventist Church on that,” he said.

Zimbabwe: Lesbian Activist Acquitted by Court

Amnesty International has welcomed a Zimbabwe court’s decision to acquit a lesbian, gay, bisexual and transgender (LGBT) rights activist charged with possession of pornographic materials.

Ellen Chademana, an administrative assistant at the prominent NGO Gays and Lesbians of Zimbabwe (GALZ), was acquitted by a magistrate’s court in Harare on Thursday.

The charges followed an armed police raid on the GALZ offices in Milton Park Harare in May. Ellen Chademana was arrested and detained for six days in Harare Central Prison with a colleague, Ignatius Mhambi. Both were released on bail while the police investigation continued. Ignatius Mhambi was acquitted of his charges in July.

South Africa: Gay Zimbabwean Radio Host Plans Wedding

Former Amakorokoza star Frank Malaba, well known as Dr Phumza by followers of the series might be a man President Robert Mugabe will never like to listen to talking. Following a public revelation that he was gay, the South African actor-cum-radio personality opens up about marriage, his childhood as a gay student and his views on gay rights in an exclusive interview with NewsDay.

Malaba became the first Zimbabwean to declare that he loves other men. Asked how his life has been after he opened up: “My life has been changed around for the better and I get inbox messages from young and old alike saying they respect my standing and who I am. I get young Zimbabweans, South Africans and on occasion Tanzanians and Kenyans asking for advice.

“On one occasion I got a message from a Zimbabwean man who has been married out of fear of being persecuted by family and friends for his sexual orientation.”

Zimbabwe: Multiple Wives? Great! Gay People? Not So Much

President Robert Mugabe says he supports polygamous relationships and justified the controversial statement by claiming that even in the bible people married many wives.

Addressing a gathering of pilgrims from across Africa in Marange on Saturday, to mark the Johanne Marange Apostolic Sect’s annual Passover, Mugabe once again castigated gays and lesbians describing them as worse than pigs and dogs. He said it was better to marry many wives than to engage in gay and lesbian relationships.

“Our Constitution allows polygamy. We will not force people into monogamous marriages. It’s there even in the bible – Solomon was not only given wealth but many wives,” said Mugabe who had children with current wife Grace while former first lady Sally Mugabe was still alive. He said the apostolic sect therefore had a right to be polygamous.

Zimbabwe: Gay Rights Workers Tortured, Released After 6 Days

Two gay rights activists in Zimbabwe have been freed after six days in police custody where it is claimed they were abused and tortured. Ellen Chadehama and Ignatius Mhambi were arrested last week accused of possessing pornographic material and insulting president Robert Mugabe.

Their employer, Gays and Lesbians of Zimbabwe (Galz), said the two were assaulted by police while in custody. They were also made to bend their knees into a sitting position with their arms outstretched for long periods and struck with bottles when they weakened and fell, according to their defence attorney, David Hofisi.

Nelson Chamisa, a government minister and spokesman for the Movement for Democratic Change, condemned the alleged abuse: “Ill treatment or inhumane handling of any human being for any reason goes against our philosophy. We do not believe harassment is the best way of doing business. It flies in the face of the democratic order.”

Holy War Against Gays in Africa

In Uganda, there is a burning desire to send them to the gallows. Woe betide those who dare “marry” in Malawi. In Zimbabwe, President Mugabe and Premier Tsvangirai have surprisingly agreed to refuse to consider their rights in the new constitution, with the former describing them as “pigs” and “dogs”. In 38 of the 53 countries on the continent, homosexuals are treated like criminals.

Same-sex marriage has been legal in South African since 2006. But it is an exception. South Africa has become a whole new universe of tolerance, severed from a continent where homosexuality, often violently punished, is considered as an unnatural act, an abomination. According to AIDES, an NGO that fights against the spread of HIV/AIDS, of out of 53 African countries, 38 of them criminalize sexual relations between persons of the same sex. Penalties range from six months to 14 years imprisonment, depending on the country.

In Sudan, where the Islamic law (Sharia) in force calls for the execution of people who engage in same sex relations, no one has yet been killed by the law for homosexual act. But Frederic Moreau, General Secretary of another NGO, Ensemble Contre La Peine de Mort (Together Against Death Penalty), begs to differ: “In Sudan, even if there is no execution, it is extremely dangerous for the sharia to be involved (in this issue), because countries that apply those laws, whereby homosexuals are executed, can one day be cited as a pretext to condemn and execute.”

Zimbabwe: President Confirms No Gay Rights in New Constitution

Zimbabwe’s president says gay rights will not be protected in a constitution being drawn up under a power-sharing deal. State radio on Friday quoted President Robert Mugabe saying that Western rights groups have called for constitutional reforms to include gay rights. He calls that “insanity.”

Same-sex acts are illegal in Zimbabwe. Mugabe once described homosexuals as “lower than pigs and dogs.”

Condemnation of gays is common in Africa. Ugandan lawmakers have proposed imposing the death penalty on some gays. A gay couple is on trial in Malawi, charged with unnatural acts and gross indecency.

Zimbabwe: Gay Rights Proposal Draws Fire

The gay rights constitutional proposal by the MDC-T has sparked outrage in Bulawayo and Victoria Falls with residents describing the proposal as “an act of the devil”. Bulawayo United Residents Association (Bura) chairman Mr Winos Dube said homosexuality was an ungodly act, which should never be tolerated.

“Never, never, never, never should this be allowed in our country. It’s ungodly and unAfrican. It’s totally against our culture and our nation will be cursed if we allow that to happen,” he said. “Even animals respect each other, why should we not respect each other. A pig can tell a male from a female. You will never see a male pig trying to mate with another male.”

Mr Dube said Zimbabweans should not allow the West to impose their culture on them on the basis of advancing human rights.
