Belize: Judge May Strike Down Sodomy Law

A ruling is due shortly that could axe Belize’s ban on gay sex.

Gay Star News reports:

Belize is preparing for their law against sodomy to be struck down by the courts. Gay anal sex, considered ‘against the order of nature’, is illegal in Belize and can get you 10 years jail – but a court case is trying to change that… The case against Section 53, the anti-gay section of Belize’s criminal code, is being brought by Caleb Orozco, the brave head of the Central American nation’s main LGBT organization, UNIBAM. He says the law violates three sections of the country’s constitution and wants it changed so sex between consenting adults doesn’t count. At the moment a straight couple having anal sex are also breaking the law. UNIBAM is still awaiting a ruling on the case in May, which appeared to go well. But in the meantime, the government appears to be preparing.

It’s an important step that would give dignity to the country’s same sex couples, as well as providing them protection from a dangerous law.

Belize: Government, Christian Groups Fight in Court to Keep Homosexuality Illegal

As the country’s Supreme Court gets ready t hear a challenge against the country’s sodomy law. the Government and Christian groups are fighting to keep it. O-blog-dee-o-blog-da reports

The nation of Belize, bordered by Mexico and Guatemala, is the last country in Central America where homosexual acts are still illegal and punishable by long prison terms. But that could change for Belize and set an important precedent for the rest of the Caribbean Commonwealth. Starting Tuesday, May 7th, Belize’s Supreme Court will hear a challenge to the country’s sodomy law which not only outlaws homosexuality but treats it as if it was the same thing as bestiality… The battle lines are drawn between Caleb Orosco, a human rights activist, the claimant in the case and various organizations against the government of Belize, along with a consortium of Christian Churches.

If the law is overturned, it will be legal to be gay in all of Central America.

Belize: Supreme Court to Debate Sodomy Law Next Month

The Belize Supreme Court is set to debate the repeal of the country’s sodomy law next month. Pink News reports:

Under the code, gay citizens face a penalty of up to ten years’ imprisonment. Section 53 states: “Every person who has carnal intercourse against the order of nature with any person or animal shall be liable to imprisonment for ten years.” The United Belize Advocacy Movement, UNIBAM, is part of a constitutional challenge to overturn the ban on same-sex sexual activity.

These laws are coming up for review, and being repealed, with increasing frequency.

Belize: Supreme Court to Decide if Homosexuality is Legal Next May

The Supreme Court of Belize will decide on the future of the Central American country’s colonial era sodomy law early next year, with a hearing set to begin on May 7.

Prospects for the hearing did not look good at first when Justice Michelle Arana decided that LGBT rights group the United Belize Advocacy Movement (UNIBAM) could not challenge the constitutionality of the law as it was not a person in May of this year.

However she allowed UNIBAM president Caleb Orozco to challenge the law as an individual and has now allowed UNIBAM to participate as an interested party in the case as she had already allowed representatives of Christian churches in Belize to be interested parties along side the government of Belize.

Belize: Criminality of Homosexuality Challenged in Court

Under Belize’s Criminal Code, gays face a penalty of up to 10 years’ imprisonment.

Section 53 states: “Every person who has carnal intercourse against the order of nature with any person or animal shall be liable to imprisonment for ten years.”

Who is challenging the law?

Caleb Orozco is the lead claimant in the case against the Attorney General and the government along with other interested parties opposed to the criminalisation of homosexuality in Belize: the Commonwealth Lawyers Association, the International Commission of Jurists and the Human Dignity Trust.

Belize: Group Files Suit Against Sodomy Law, Prime Minister Silent

Belize PM Dean BurrowThe United Belize Advocacy Movement, UNIBAM, a gay rights group is generating lots of buzz with a case it has taken to the Supreme Court Of Belize.

UNIBAM has filed a motion against the attorney general challenging the constitutionality of section 53 of the Belize Criminal Code, which criminalizes “carnal intercourse against the order of nature with any person” which is basically a law banning sodomy.

The case has attracted major international attention. The Commonwealth Lawyers Association, the Human Dignity Trust and the International Commission of Jurists have joined as interested parties on the side of UNIBAM.
