Wisconsin Domestic Partner Registry Upheld By State Supreme Court

Wisconsin MapThe Wisconsin Domestic Partner Registry was upheld as constitutional by the state Supreme Court yesterday.

Gay Star News reports:

Same-sex couples still can’t get married in Wisconsin but they can continue to register to have some of the rights heterosexual married couples automatically have. The state’s supreme court ruled Thursday (31 July) that a 2009 that established a registry for same-sex couples in 2009 does not violate the state’s ban on gay marriage. The registry grants same-sex couples such things as insurance benefits under their partner’s plan, the right to inherit assets upon the death of their partner as well as hospital visitation and medical leave to care for their partner.

Funny how AG Van Hollen, who claimed that “The most important duty of Wisconsin’s Attorney General is to defend our state laws and Constitution” in defending the state’s ban on marriage equality, had no interest in defending this other state law. Hypocritical much?

USA, Florida: Statewide Domestic Partner Registry Planned?

Florida Representative Linda StewartA Democratic state representative in Florida is working on passing a domestic partner registry bill once again.

Watermark reports:

State Rep. Linda Stewart (D-Orlando) is working on resurrecting a bill in 2014 that would implement a statewide domestic partner registry. It was submitted to bill drafting in mid-December, and she hopes to secure a Republican co-sponsor. Last year’s bill, sponsored by Mark S. Pafford (D-West Palm Beach), died when not one Republican committee chair would consider it. A companion senate bill passed one senate hearing, Children, Families and Elder Affairs, a committee chaired by Democrat Eleanor Sobel (D-Hollywood). A month later, it died in the Judiciary Committee, despite the fact that a poll earlier this year showed that 75 percent of Floridians support either gay marriage or civil unions, according to the Bob Graham Center for Public Service.

It’s not even civil unions. So why can’t as basic a bill as this get through the Florida legislature?

USA, Wisconsin: State Supreme Court to Hear Arguments This Week on Domestic Partner Registry

Wisconsin MapThe state Supreme Court in Wisconsin is set to hear arguments this week on whether the message partner registry is constitutional.

LGBTQ Nation reports:

The registry grants same-sex couples a host of legal rights. Members of the conservative group Wisconsin Family Action filed a lawsuit in 2010 alleging the registry violates a 2006 state constitutional amendment banning same-sex marriage or anything “substantially similar.” A state appeals court upheld the registry last year, noting married couples enjoy a number of rights registrants don’t.

It’s just astonishing to me that we now have marriage equality in 14 states, and yet in Wisconsin we’re still fighting over whether we can even have a domestic partner registry.

Also in Wisconsin, gubernatorial candidate Mary Burke says she supports marriage equality.

Democratic gubernatorial candidate Mary Burke says she supports gay marriage and opposed a 2006 constitutional amendment in Wisconsin that prohibited gay marriage and civil unions. Burke voiced her support for gay marriage during an interview on Monday with the Milwaukee Journal Sentinel.

It’s time to move past defending the domestic partner registry, and to go on the offensive with the marriage equality bill or lawsuit.

USA, Georgia: Atlanta Suburb Adds Domestic Partner Registry

Gay Couples Denied Marriage Licenses in Decatur, GeorgiaAvondale Estates, Georgia just became the fourth Georgia municipality to add a domestic partner registry ordinance. The Washington Blade reports:

The City of Avondale Estates Board of Mayor and Commissioners unanimously approved the resolution that will allow for the formal recognition of same-sex and opposite-sex couples. “Adding this new service for our residents is a means of showing respect and recognition to the many couples we have living in our city,” Mayor Ed Rieker said in a statement.

Texas, USA: Dallas County District Attorney Backs Marriage Equality, Suggests Registry

Dallas County District Attorney Craig WatkinsThings are moving along at the local level in Texas as Dallas County District Attorney Craig Watkins suggests the county create a domestic partner registry. The Dallas Voice reports:

Dallas County District Attorney Craig Watkins came out in support of marriage equality Tuesday and proposed that the county establish a domestic partner registry similar to one administered by Travis County. Watkins, a two-term incumbent who is facing a possible challenge in next year’s Democratic Primary from former Judge John Creuzot, addressed Stonewall Democrats of Dallas during the group’s monthly meeting at Ojeda’s Restaurant on Maple Avenue. Watkins delivered what appeared to be his standard stump speech to the group’s membership, and he didn’t mention LGBT issues. But he spoke to Dallas Voice in an exclusive interview after the meeting.

Small steps, but still, as with the civil unions ordinance in Bisbee, Arizona, it’s a start.

Florida, USA: Senate Committee Advances Domestic Partnership Bill

Florida From SpaceThere’s some movement on Florida’s proposed Domestic Partnership bill – it passed out of a Senate committee on a 5-4 vote. Towleroad.com reports:

The DPR would provide essential legal protections for unmarried couples, including hospital visitation, correctional facility visitation, end of life decision-making and burial arrangements, according to Equality Florida: A majority of Floridians already live in a local community that has a domestic partnership registry. Pinellas County, Volusia County, Orange County, Broward County, Miami-Dade County, Key West, Tampa, Orlando, Gainesville, Tavares, Clearwater and North Miami already have registries. The Families First bill would eliminate the patchwork of policies and allow people to have important legal protections for their family, no matter where they live in the state.

The bill apparently passed with both democrats and republicans voting for it bu a 5-4 margin. But will it face the same fate in the full Senate?

Wisconsin, USA: State Supreme Court Upholds Domestic Partner Registry

Wisconsin Supreme Court Upholds Domestic Partner RegistryThe Wisconsin Court of Appeals today upheld as constitutional the state’s Domestic Partner Registry.

In affirming a lower court decision that the law does not violate the state’s constitutional amendment banning marriage equality, the court stated:

“… it would ‘take pages’ to list the rights and obligations that go with marriages but not domestic partnerships … It is not necessary to list that many here to demonstrate that … the rights and obligations of marriage are not substantially similar to the rights and obligations of domestic partnerships.”

Minnesota, USA: Another City Approves Domestic Partner Registry

Minnesota, USA: Another City Approves Domestic Partner Registry (Patch.com) With no discussion, the Northfield City Council on Tuesday apprWith no discussion, the Northfield City Council on Tuesday approved the second reading of the domestic partner registry ordinance with a 6-1 vote. The ordinance is effective July 23.

Northfield becomes the 19th Minnesota city to pass a domestic partner registry ordinance, according to the Research and Inquiry Department of the League of Minnesota Cities and LGBT advocacy organization OutFront Minnesota. The vast majority of these communities are located within the Twin Cities metro area.

The League of Minnesota Cities defines a “domestic partner” as “two adults who share an emotional and financial relationship but choose not to marry or cannot legally marry.” Domestic partner benefits can include health and dental insurance, employee assistance program, dependent life insurance and family medical leave.

Ohio, USA: Columbus Plans Domestic Partner Registry

Columbus, OH Domestic Partner RegistryIt’s been 31 years since a handful of gays and lesbians took to the streets to bring attention to LGBT issues. And with each passing year, the gay community draws just a little closer to the social and legal equality it continues to fight for. Just last week, another small victory was claimed in the city of Columbus.

In February, the LGBT advocacy group Equality Ohio released a statement that praised six Ohio mayors who had endorsed the Freedom to Marry campaign–a list of U.S. mayors who supported gay marriage. Mayor Michael Coleman was not one of them.

Last week, however, he may have reestablished his gay cred after city hall announced it would create a domestic-partnership registry–a registry that would, in effect, recognize both straight and LGBT marriages in the eyes of the city.

Australia: LNP Wants to Downgrade Queensland’s Civil Unions to a Domestic Partner Registry

Queensland Marriage Equality RepealThe civil unions bill could morph into a relationships registry under an LNP government in a left-field move a top lawyer believes is being seriously considered.

LNP leader Campbell Newman has refused to say exactly what he will do with the civil unions bill introduced last year if he wins government on Saturday.

Mr Newman has said the LNP would like to repeal the bill, but insisted he did not want to leave couples already in civil unions in “legal limbo”.
