USA, Arkansas: One County Lets Couples Marry, AG Requests Stay – What Happens Monday?

ES6Couples are marrying in Carroll County.

ABC News reports:

Gay marriage arrived in the Bible Belt on Saturday, beginning with two women who had traveled overnight to ensure they’d be first in line. “Thank God,” Jennifer Rambo said after Carroll County Deputy Clerk Jane Osborn issued a marriage license to her and Kristin Seaton, a former volleyball player at the University of Arkansas. The Fort Smith couple wed moments later on a sidewalk near the courthouse; the officiant wore a rainbow-colored dress. In total, 15 licenses were issued for same-sex couples in northwest Arkansas’ Carroll County, Osborn said.

The morning wasn’t without drama.

LGBTQ Nation reports:

As dawn came, no one was certain that any clerk would issue a marriage license to a same-sex couple. Initially, deputy clerk Lana Gordon said she wasn’t sure she had the authority and shooed the couples from her office. “We just walked out of here crying,” Rambo said. But once Osborn intervened, other same-sex couples let the couple return to their place in line. “And some of these people here have been waiting 50 years and they still instructed us to come up front,” Rambo said.

Other county clerks are conflicted.

The Arkansas Times reports:

County clerks and attorneys had their conference call with Association of Arkansas Counties officials this afternoon about complying with Circuit Judge Chris Piazza’s ruling overturning the state Constitution and 1997 statutory ban on same-sex marriage. They’re hoping for further court guidance and, ideally, a stay of Piazza’s ruling. Otherwise, confusion and unhappy customers seem likely to be the order in Arkansas when business resumes Monday morning…

Some feathers seem likely to be ruffled Monday morning. A number of clerks already have received inquiries from same-sex couples hoping to be married. But the consensus of the session — led by opinions from David Hogue in Conway, Ralph Ohm in Hot Springs and George Spence in Bentonville — was that the lack of proper forms was an adequate ground to refuse issuance of a license to a same-sex couple because otherwise the clerks would be issuing an incorrect document that could ultimately cause legal problems. Ohm suggested counties shouldn’t hurry the process of getting proper forms ready.

The Attorney General has requested a stay.

Pink News reports:

The Attorney General Dustin McDaniel yesterday filed for a stay, which would put the ban back in place and prevent recognition of same-sex marriage until the appeals process is concluded. It could take several months for an appeal to conclude, as it would likely go all the way to the Supreme Court.

It’s not clear which other counties will allow same sex couples to marry come Monday morning if no stay has been issued.

USA, Arkansas: No Stay in Marriage Equality Ruling

ArkansasThe judge in Arkansas has not stayed his ruling. Eureka Springs plans to begin issuing marriage licenses to same sex couples this morning.

Arkansans for Equality reports that the clerk’s office in the tiny town of Eureka Springs will be open to issue marriage licenses at 9AM today. There is no waiting period in Arkansas and proof of residency is not required, so hello Oklahoma and Missouri. If you want to get married right away in Arkansas, the Eureka Springs office is only open until 1PM so today’s four hour window might be your only chance in the short term.

While there is no stay yet, one has been requested.

Meanwhile, if there’s no stay by Monday morning, other counties may also start issuing licenses to same sex couples… Same-sex couples in Arkansas could begin to marry on Monday, after a judge struck down the state’s same-sex marriage ban… Larry Crane, the Pulaski County Clerk, confirmed to the Arkansas Times that he will be ready to issue marriage licenses to same-sex couples by Monday morning.

So we may see some same sex weddings in Arkansas this weekend – amazing.

Arkansas, USA: Eureka Springs Endorses Marriage Equality

Eureka Springs, Arkansas Endorses Marriage EqualityDespite a state constitution that specifically prohibits same-sex unions, Eureka Springs on Monday became the first city in the state to officially endorse the idea by a vote of the city council.

Two leaders of a low-profile campaign to persuade the council to adopt a resolution supporting marriage equality spoke in favor of the measure. Lamont Richie, a former city official and currently a Carroll County Quorum court judge, was blunt about the resolution’s intent.

“This will put you on record as supporting marriage equality,” he said.

Although no opponents of marriage equality appeared at the meeting, Richie anticipated conventional arguments against the notion. “I disagree with the conclusion that someone else’s religious belief should deny me and my partner of nearly 28 years the choice to enter into a legal relationship.”

Michael Walsh, a retired journalist who authored the city’s precedent-setting 2007 Domestic Partnership Registry–the first and still only one in the state–told the council, “True equal marriage rights are a long way off in Arkansas and the South. We know that. But the resolution before you is powerfully symbolic and potentially influential. Tonight, you can jump-start history.”

Before his comments, Walsh submitted a 33-page list containing the names of more than 700 supporters, including former Eureka Springs mayor Dani Joy and AR State Rep. Kathy Webb.

Of the petitioners, Walsh said, “They know Eureka Springs is the only city in Arkansas that can do this and, certainly, the one city that should.”

Without discussion and with one council member voting “present,” a four-member majority approved the measure.

Eureka Springs (pop. 2300), a thriving tourist town listed on the National Register of Historic Places is often cited by travel publications as “the San Francisco of Arkansas,” as much for the high-visibility rainbow flags adorning downtown storefronts and its disproportionately large gay and lesbian population as for its steep and narrow streets, reproduction trolleys and turn-of-the-century Victorian homes.

Long a destination for gay and lesbian vacationers, the town has three “Diversity Weekends” each year and more than 50 gay-owned businesses.

The city’s now-official endorsement follows by less than six weeks the same action in Austin, TX.

AR: Eureka Springs Adds Health Coverage for Domestic Partners

Eureka Springs Domestic Partner BenefitsEureka Springs, Ark., long known as a gay tourist destination, has become the first city in the state to offer health benefits to the domestic partners of municipal employees, according to a press release we received Monday: The only city in Arkansas with a Domestic Partnership Registry today became the first city in the state to provide health care coverage for the domestic partners of municipal workers.

The city’s insurance provider, the Arkansas Municipal League, notified the city that beginning January 1, 2011 both same- and opposite-sex partners of city workers will have the same access to health insurance as legal spouses.

The announcement culminated a year-long campaign by residents of the Northwest Arkansas tourist town which in June 2007 became the first city in the state to enact a Domestic Partnership Registry ordinance to officially recognize unmarried couples in committed relationships.
