USA: Medicare Now Open to Married Same Sex Couples

MedicareOne more step in the implementation of last year’s DOMA ruling.

The Advocate reports:

The U.S. Department of Health and Human Services has updated Medicare rules so that couples in same-sex marriages can apply for benefits covering hospital stays and physician care. The new rules “help to clarify” the effects of the Supreme Court’s decision last year striking down a key section of the Defense of Marriage Act and therefore allowing the federal government to recognize same-sex marriages. HHS secretary Kathleen Sebelius said today in a press release.

One more step forward for married same sex couples. The arc of the moral universe is bending quickly now.

USA: Medicare Puts Off Decision on Paying Costs of Gender Reassignment Surgery

The United States Department of Health and Human Services backed off a planned decision on whether Medicare should cover gender reassignment surgeries. The Advocate reports:

Friday morning the Center for Medicare and Medicaid Services, which runs the government’s national insurance program, published an announcement on its website that it would be seeking public input on its reconsideration whether or not to cover gender reassignment surgery for people on Medicare, as The Advocate reported. But later that same day, HHS issued a contradictory statement, and the center withdrew its request for comment on the potential policy change.

White House Issues New Rules for Hospitals on Sexual Orientation/Gender Identity

White House Issues New RulesToday the White House announced the publication of rules prohibiting Medicare and Medicaid hospitals from denying visitation privileges on the basis of race, color, national origin, religion, sex, sexual orientation, gender identity, or disability.

The rules were created in response to a Presidential Memorandum issued earlier this year which instructed the Department of Health and Human Services to create new rules allowing patients the right to choose their own visitors during a hospital stay.

Today, the Centers for Medicare & Medicaid Services (CMS) has issued that rule – a rule that will let patients decide whom they want by their bedside when they are sick – and that includes a visitor who is a same-sex domestic partner. The rule presents an important step forward in giving all Americans more control over their health care.
